General Terms

By accessing and using Bukios through our website, mobile applications (iOS and Android), browser extension, or any other channel, you confirm that you are in agreement with and bound by the terms of service contained in the Terms & Conditions outlined below. These terms apply to the entire platform and any email or other type of communication between you and Bukios.

Under no circumstances shall the Bukios team be liable for any direct, indirect, special, incidental, or consequential damages, including, but not limited to, loss of data or profit, arising out of use, or the inability to use, the materials on this site.

Bukios will not be responsible for any outcome that may occur while using our resources. We reserve the right to revise the resource usage policy at any moment.

Eligibility

To use Bukios, you must meet the minimum age required to provide digital consent in your country of residence in accordance with the General Data Protection Regulation (GDPR) Art. 8 and applicable national legislation (for example, 14 years in Spain under the LOPDGDD Art. 7, 16 years in Germany, 15 years in France, 14 years in Italy). If you are below that age, you may only use the service with verifiable consent from your parent or legal guardian.

To purchase a paid subscription, you must be at least 18 years old or of legal age in your jurisdiction, or have authorization from a responsible adult.

License

Bukios grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the website, mobile applications, and browser extension strictly in accordance with the terms of this Agreement.

Definitions and Key Terms

For these Terms & Conditions:

• Cookie: Small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, remember information about you such as your language preference or login information.
• Company: When this policy mentions 'Company,' 'we,' 'us,' or 'our,' it refers to Bukios, Madrid, Spain.
• Country: Where Bukios or its owners/founders are based, in this case Spain.
• Device: Any internet-connected device such as a phone, tablet, computer, or any other device that can be used to visit Bukios and use the services.
• Service: Refers to the service provided by Bukios as described in the Terms & Conditions and on the platform, including the website, mobile applications, and browser extension.
• Third-party service: Refers to external services integrated with Bukios, including payment processors, AI providers, analytics tools, and infrastructure providers that help deliver our service.
• Website: Bukios's site, which can be accessed via bukios.com.
• You: A person or entity that is registered with Bukios to use the Services.
• Premium Plan: A paid subscription that grants access to advanced features such as semantic search, knowledge graphs, evolution, insights, and cognitive profile, as well as expanded limits for bookmarks, read lists, and RSS feeds.
• Free Plan: A basic no-cost plan that allows use of the service with limits on the number of bookmarks, read lists, and RSS feeds.
• Trial Period: A limited period during which a new user can access Premium Plan features at no cost.
• Subscription: A recurring agreement between the user and Bukios to access the Premium Plan through periodic payments (monthly or yearly).
• In-App Purchase (IAP): A subscription purchased through the Apple App Store or Google Play Store, subject to the additional terms of the corresponding store.
• User Content: Any data entered or saved by the user on the platform, including bookmarks, read lists, tags, and any associated text or metadata.
• Payment Provider: An external entity that processes financial transactions on behalf of Bukios, including Stripe, Apple, and Google.
• Mobile Store: Apple App Store or Google Play Store, through which in-app purchases can be made.
• Cognitive Profile: An AI-generated analysis based on the user's reading patterns, for informational purposes only and with no legal effects.
• AI Feature: Any feature of the service that uses artificial intelligence, including semantic search, concept extraction, cognitive profile, and insights.

Restrictions

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, or otherwise commercially exploit the service.
• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the service.
• Remove, alter, or obscure any proprietary notice of the service or its affiliates.
• Use the service in any way that could damage, disable, overburden, or impair the service.

Your Content

Our service allows you to store bookmarks, create readlists, organize content with tags, and generate AI-derived insights such as cognitive profiles. You are responsible for the content you save and share through our platform.

By saving content, you retain all rights to your data. Bukios does not claim ownership of your bookmarks, readlists, tags, or any user-generated content.

Payments and Subscriptions

Bukios offers free and premium subscription plans. Payments are processed securely through Stripe, a PCI-compliant third-party payment processor. Bukios does not store your credit card details or financial information on its servers.

Subscriptions renew automatically unless cancelled before the end of the current billing period. You can manage or cancel your subscription at any time from your account settings.

Plans and Pricing

Current pricing, features included in each plan, and applicable limits are detailed on our pricing page. The Free Plan includes limits on the number of bookmarks, read lists, and RSS feeds. The Premium Plan removes those limits and grants access to advanced features. All prices are displayed in euros (EUR) and include applicable taxes.

Free Trial Period

Upon registration, each new user receives a 15-day free trial period with full access to Premium features. At the end of the trial period, if you have not purchased a paid subscription, your account will automatically switch to the Free Plan. We will notify you before your trial period ends.

Purchases Through Mobile Stores

If you purchase your subscription through the Apple App Store or Google Play Store, payment will be processed according to the terms of the corresponding store. Subscription management (cancellation, plan changes, refunds) must be done directly through the store where the purchase was made. You may only maintain one active subscription through a single store or payment platform at a time.

Cancellation and Reactivation

You may cancel your subscription at any time. After cancellation, you will retain access to Premium features until the end of the already-paid billing period, at which point your account will switch to the Free Plan. If you cancel during the trial period, you will lose access to Premium features immediately. You may reactivate a cancelled subscription before the end of the current billing period.

Price Changes

Bukios reserves the right to modify subscription prices. Any price change will be notified to you at least 30 days in advance. If you do not agree with the new price, you may cancel your subscription before it takes effect, without penalty. Continued use of the service after the new price takes effect will constitute acceptance thereof.

Secure Payments

All payments made through our platform comply with EU PSD2 regulations and may require Strong Customer Authentication (SCA) via 3-D Secure or other verification mechanisms.

Refund Policy

Bukios is responsible for your subscription to you. If you believe you are entitled to a refund, you may request one by contacting us at contact@bukios.com. Refunds will be processed through the same payment method used for the original purchase (Stripe, Apple App Store, or Google Play Store). For subscriptions purchased through mobile stores, refunds must be requested in accordance with the policies of the corresponding store. Refunds are evaluated on a case-by-case basis and are subject to applicable consumer protection legislation.

Right of Withdrawal

In accordance with Directive 2011/83/EU, you have the right to withdraw from your subscription contract within 14 calendar days from the date of purchase, without needing to provide any justification.

By purchasing a Premium subscription and requesting immediate access to the digital content, you expressly agree that the service begins during the withdrawal period and acknowledge that you will lose your right of withdrawal once the digital content has been made available to you.

This consent is collected explicitly during the purchase process through an unambiguous declaration before completing the payment.

AI and Automated Processing

Bukios uses artificial intelligence to enhance your experience. Articles you save may be processed to extract key concepts, generate semantic embeddings, and build your personal knowledge graph. This processing is performed using a combination of on-server technologies and third-party AI services (OpenAI for text embeddings).

Only the text content of saved articles is sent to AI providers for embedding generation. Your personal data, account information, and browsing history are never shared with AI providers. All AI-derived data (embeddings, concepts, cognitive profiles) is stored on Bukios servers and treated with the same privacy protections as your other data.

In accordance with Regulation (EU) 2024/1689 (Artificial Intelligence Act), we inform you that Bukios's AI features (semantic search, concept extraction, cognitive profile, AI chat) are informational-purpose systems classified as low risk. When you interact with AI-generated content, it will be clearly indicated through visible labels.

The cognitive profile is an informational tool designed to help you understand your reading patterns. No automated decisions with legal or similarly significant effects are made based on this profile (GDPR Art. 22). You have the right to request human review of any automated analysis, to obtain an explanation thereof, and to object to automated processing by contacting us at contact@bukios.com.

Intellectual Property

Bukios and its original content, features, and design are owned by Bukios and are protected by applicable intellectual and industrial property laws, including copyright, trademarks, and patents. Reproduction, distribution, or modification of any part of the service without prior written authorization from Bukios is prohibited.

Account Termination

You may delete your account at any time from your account settings. Upon deleting your account, your personal data will be removed in accordance with our Privacy Policy.

Bukios reserves the right to suspend or terminate your account if you breach these Terms & Conditions, if you use the service fraudulently or abusively, or if required by law. In the event of suspension or termination, you will be notified of the reason and offered the opportunity to download your data before permanent deletion, unless there are legal reasons that prevent this.

Digital Services Act

In compliance with Regulation (EU) 2022/2065 (Digital Services Act), Bukios establishes the following mechanisms:

If you detect content you consider illegal on our platform, you may notify us by sending an email to dsa@bukios.com indicating the URL of the content, the reason for the notification, and your contact information. We will process your notification diligently and inform you of our decision.

In the event that Bukios removes or restricts access to a user's content, it will provide a clear and specific statement of reasons to the affected user, including the facts, the legal basis, and the available appeal mechanisms.

Accessibility

Bukios is committed to ensuring the digital accessibility of its platform in accordance with Directive (EU) 2019/882 (European Accessibility Act). We continuously work to improve the experience for all users. If you encounter accessibility barriers, please contact us at contact@bukios.com.

No Warranties

The service is provided on an 'as is' and 'as available' basis. Bukios makes no warranties, expressed or implied, and hereby disclaims all warranties including, without limitation, merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

Bukios and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from the use or inability to use the service. In any case, the total cumulative liability of Bukios to you shall not exceed the amount you have paid to Bukios in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Bukios, its directors, employees, and agents from any claim, damage, loss, liability, and expense (including attorneys' fees) arising from your breach of these Terms, your use of the service, or the infringement of third-party rights.

Dispute Resolution

In the event of a dispute related to these Terms, we encourage you to contact us first at contact@bukios.com to attempt to resolve it amicably.

If you reside in the European Union, you have the right to use the European Commission's Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr/. This platform allows you to submit a complaint through an alternative dispute resolution body.

Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of Spain.

If you are a consumer residing in a European Union Member State, you will benefit from the mandatory provisions of the consumer protection legislation of your country of habitual residence, in accordance with the Brussels I bis Regulation (Art. 17-19) and the Rome I Regulation (Art. 6). Nothing in these Terms limits your rights as a consumer under applicable legislation. The competent jurisdiction shall be the courts of Madrid, Spain, without prejudice to the forums available to you as a consumer.

Modification of Terms

Bukios may modify these Terms & Conditions at any time. We will notify you of any material changes at least 30 days in advance by email and a prominent notice on the platform.

If you do not agree with the new terms, you may cancel your account and subscription before they take effect, without penalty. Continued use of the service after the effective date of the new terms will constitute your acceptance thereof.

Governing Language

The Spanish version of these Terms & Conditions is the official and binding version. Translations into other languages are provided for informational purposes only. In the event of a discrepancy between the Spanish version and any translation, the Spanish version shall prevail.

General Clauses

Entire Agreement

These Terms & Conditions, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Bukios regarding the use of the service, and supersede any prior agreements.

Assignment

Bukios may assign or transfer these Terms, or any rights or obligations arising from them, to a third party without your prior consent. You may not assign or transfer your rights or obligations without the prior written consent of Bukios.

No Waiver

The waiver by Bukios to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision in the future.

Force Majeure

Bukios shall not be liable for any failure or delay in the performance of its obligations caused by circumstances beyond its reasonable control, including natural disasters, armed conflicts, pandemics, Internet infrastructure failures, governmental acts, or third-party provider failures.

Export Controls

You agree to comply with all applicable export control laws and sanctions regulations in your use of the service.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.
